Forming a company in Kuwait

Companies in Kuwait are governed principally by the Companies Law, Decree-Law No. 1 of 2016, and are registered through the Ministry of Commerce and Industry. The choice of company form, the shareholders' rights, the management structure and the articles of association all have lasting legal consequences, and they are difficult to correct once a company is registered.

We advise on which form suits the business, prepare the constitutional documents, and coordinate the registration and licensing steps with the competent authorities. Where foreign ownership is involved, we advise on the ownership route, including the licence route through the Kuwait Direct Investment Promotion Authority (KDIPA), on our foreign investment page.
