Who regulates funds in Kuwait
Securities activity in Kuwait is regulated by the Capital Markets Authority, established by Law No. 7 of 2010, and the Authority's executive bylaws and rules govern the licensing of those who carry on regulated activities and the offering of collective investment schemes. Boursa Kuwait is the exchange. A fund that is formed or marketed in Kuwait, or a manager that operates one, needs to be placed correctly within that framework from the start.
We advise on how a proposed fund fits the framework, which approvals or licences are involved, and what documentation each step requires. The decision to license or approve rests with the Authority.
Fund formation and documents
The documents of a fund set out the rights of unit holders and the duties of those who run it. Errors in them are costly to correct once investors have subscribed. We prepare and review the documents on which a fund depends.

Licensing coordination
Managers and other firms that carry on regulated securities activities must be licensed by the Capital Markets Authority. We coordinate the legal side of the application: the corporate structure of the applicant, the supporting documents and the correspondence with the Authority, so that the application is complete and consistent.

Ongoing regulatory obligations
